This is a working draft, not a finalized legal document — it accurately describes how the product actually works, but should be reviewed by a lawyer before being relied on as binding.
These Terms of Service ("Terms") govern your use of Position-Me, a positioning-assessment product operated by Ghayah ("we", "us", "our"). By creating an account, submitting a self-assessment, responding to someone else's assessment link, or making a purchase, you agree to these Terms.
What Position-Me Is
Position-Me lets you run a short self-assessment about how you position your work, then invite colleagues, clients, and peers to anonymously say how they actually see you. Free use includes taking the self-assessment and collecting responses. Paid tiers (Act and Mastery) unlock a ranked action plan built from your results, and Mastery additionally unlocks a follow-up re-test cycle to measure whether your positioning has actually moved.
Accounts and Eligibility
You need an account to take the self-assessment or view your results — created via a one-time email link or LinkedIn sign-in, no password required. You're responsible for keeping access to your email or LinkedIn account secure, since that's what controls access to yours. The service is intended for working professionals evaluating their own market positioning; it isn't directed at children, and you must be old enough to enter into a binding agreement in your jurisdiction to make a purchase.
Payments, Pricing, and Promo Codes
Act and Mastery are one-time purchases, not subscriptions — you pay once and keep access, with no recurring charge. Prices are shown in USD at the time of purchase and processed securely by Stripe; we never see or store your card details. If you already own Act and upgrade to Mastery within the stated upgrade window, you're charged only the price difference, not the full Mastery price again — after that window, upgrading costs the full price. Promo codes, where offered, are subject to their own stated terms (expiry, usage limits, and scope) and may be changed or withdrawn at any time without notice.
Refunds
If something went wrong with your purchase — a technical error, an accidental duplicate charge, or you're simply not satisfied — contact us at support@bariz.io and we'll work it out, typically within 14 days of purchase. Refunds are issued back to your original payment method through Stripe.
Anonymous Respondent Submissions
If someone shares their assessment link with you and you respond, your response is submitted anonymously by design — we do not collect your name, email, or any identifying information as part of that submission, only your answers and a general relationship category (peer, client, or leadership) that you select yourself. Neither we nor the person who shared the link can trace a specific response back to you.
Acceptable Use
Don't use Position-Me to harass, impersonate, or submit deliberately false responses about someone; don't attempt to identify an anonymous respondent through any means outside the product; don't scrape, reverse-engineer, or automate bulk submissions against the service; and don't attempt to circumvent payment, promo-code, or rate-limiting mechanisms. We may suspend or terminate accounts that violate these terms.
Intellectual Property
Position-Me's software, design, and the underlying action-plan content library are owned by Ghayah. Your own self-assessment answers and the responses you receive belong to you to use as you see fit — including downloading and sharing your report.
Disclaimers
Position-Me's assessment, archetype diagnosis, and action plan are guidance based on the input you and your respondents provide — they are not professional career, legal, or business advice, and we don't guarantee any particular outcome from following them. The service is provided "as is" without warranties of any kind.
Limitation of Liability
To the maximum extent permitted by law, Ghayah's total liability for any claim relating to Position-Me is limited to the amount you paid us in the 12 months before the claim arose. We are not liable for indirect, incidental, or consequential damages.
Changes, Termination, and Governing Law
We may update these Terms from time to time; continued use after a change means you accept the updated Terms. You may stop using the service and request account deletion at any time. These Terms are governed by [governing law jurisdiction — to be confirmed].
